The choice of strategy is, of course, important in each and every proceedings, also in commercial disputes. However, the Commercial Courts regularly make particularly stringent demands on the substantiation of the party's statements. This means that the statements of facts must be made with a very high degree of detail; denials need to be specific and must state with particularity any supporting facts. Accordingly, the meticulous detailed work and the intensive fact-based collaboration between the litigant and the litigation attorney are indispensable for a successful completion of the lawsuit. It can be said from experience that the party that can process, and prove, its facts better and more precisely has an advantage over the other party.
